fresh install of vista 32 using photoshop cs4 with wacom cintiq, not getting any pressure sensitivity when i look in the other properties tab theres a lil "!" symbol, latest drivers for the wacom. and in the wacom settings it shows the pressure sensitivity working, but it does not work in photoshop!! its making me go grrr…

have you tried the photoshop image browser? it's Ctrl+Shift+O in photoshop - or found under the file menu. It's a bit slow compared to other image browsers like ACDSEE but is already setup to open the images in photoshop. I use it all the time for browsing textures.

I'm pretty sure that's not a bug but just how the photoshop brush preview works. My photoshop and the images I find on google all show the exact same as your preview does. Only (some?) default photoshop brushes seem to have the pen pressure previews.
