It's hard to get the full scope of the model from this angle. Do you have front 3/4 and rear 3/4 shots? 5k tri count seems reasonable on a vehicle, but it's hard to tell without wires. One should be able to argue against the 50k fine that if you've signed a contract with a development team before the ban was passed, then it seems like you should be legally able/liable to complete the contract with the game developers, and not be forced to abandon it.
How many tris are in the meshes your using for emssion? UDK won't even use a mesh with 5k tris, so if your using something with 500 or 1000 it will spike lightmass times pretty badly.
