I managed to figure out the solution to both issues! The warnings seem to have been caused by trying to declare and set both arrays before the first for loop. Select those edges in Border selection (3) not in edge selection (2) and then use Bridge tool. Works for me every time. -

Looks like you have some unwelded vertices there. Select the offending faces, convert selection to vertices, do a Weld action on the selection. -

MODO - Export FBX with multiple layers
I selected both layers in item mode, then right click and used 'Export Selected Layers' - I selected FBX export and 'Just Layers' in the export options popup. My FBX export settings:
