It was attempted and squashed already in Oblivion.
I helped work on a 007 mod for Half Life 2, and it never had any issues. It was even published in Game Informer like 4-5 years ago.
I got started with mods about 14 years ago - even back then, it was more likely than not that using copyrighted material will get you cease & desisted. When it happens the terms usually involve cease any and all display of copyrighted material so you don't even get portfolio pieces out of it.
Not trying to start an argument about it, just know what you're getting yourself into. Companies have only gotten more protective of their IPs since AvP Quake & Southpark Quake got squashed.
You can do something that's similar to lord of the rings without infringing - heck, listen to the Skyrim title theme song, it's hitting a lot of Lord of the Rings queues without infringing.
Make a LOTR mode that is generic as hell, and mash in the other lesser famous books without including the more iconic persona's and you have a chance of actually not getting IP-blocked.

I'm not worried about it. I stopped helping with it back in like 2006. They are still working on it though, have been since like 2005 or whatever.
From a fans point of view that would be pretty much pointless. Like having a superman game that doesnt feature superman anywhere in the game. The whole reason people would want to do a lotr mod is cause they love the recognisable characters and environs, take those out and its not lotr really, its just boring generic medieval fantasy.
Im up for making a mod but not really one based on lotr or starwars or some big label that could shut it down. I feel it would be more useful to make our own mod like "guild of the dragon riders" or something silly like that, that way we could make any crazy awesome stuff that fits the theme.
Jokes aside, a mod for skyrim should be high quality, well balanced and follow the lore of the world that is set before it.
As an example: there hasn't been any kind of dragon riding in elderscrolls, it makes as much sense as riding around on khajiit.
Never thought of it that way, I imagine it more like dragonheart.
Also, UI - good god I can't stress that enough. The game needs a UI mod PC pronto.
As for a pcount challenge, that would be awesome once the tools come out
It would be so much better if you could just make your horse stomp on them for a knockdown and damage that would give you a chance to prepare to fight.

EDIT: Whatever happens. I'm doing coconuts for companions and killer rabbits....oh oh oh and a 3 headed giant, and a knight that says ni, and camelot (it is a silly place), and, and, and, the guy who says bring out your dead, and witches that weigh less than a duck, and the black knight (with detatchable limbs), and a police car, and ......
Or better yet, be able to shoot your bow and arrow while on your horse. That royally pisses me off when I can't do that. Zelda games are like that too.
I'm sure the developer guys have their reasons, mind.
Unlike mods for others games it would only take a few weapons from a few polycounters and it's a mod already, with the actual mod-work just taking an hour at most.
We're not talking total conversions here :P
