After recruiting programmers We realised We need more Artists.
The game places the player in control of a dungeon and he must use his workers to dig out and build a dungeon while attracting creatures who will train, feed and sleep in the players dungeon. The Creatures will then fight for the player against other players who have done the same thing. Player territory will be signified by tiles that are coloured in the players colour placed around. The tiles can be claimed by workers. edit. your concepts have been taken exactly from dungeon keeper. While Bullfrog have dissapeared, i believe the rights to the game still belong to someone. I think it would be best to do your own work. (Unless you of course own the rights to the game, and im talking crap)
I'd be keen to work for this project granted its a game that pays homage in its own unique way, rather than attempting to copy dungeon keeper exactly.
We plan to use assets from the original game while making our own to create something of a sequel. We have called numerous offices and they said it should be ok if no profit is involved, EA have never contacted us or any of the other dungeon keeper projects saying "Stop" so I see no reason why we should halt.
The cease & desist take down notice will most likely arrive late in development or after you release the game. They are usually pretty harsh requiring you to not only stop development but remove all evidence that the game existed, here's a tidbit from the Alien Quake take down notice:
"Therefore, you are hereby ordered to remove all your Alien Quake files from your computer storage. You must also remove all references to Alien Quake from any WWW pages or internet sites you keep or maintain. All distribution of Alien Quake is illegal and you should know that the Alien Quake team are under obligation to report the name and URL of any distributor to 20th Century Fox. Please let us know if you know the URL of a distributor or potential distributor."
this happened around 1997, people referred to it as being "FOXed" and it has happened many times since. There was a South Park quake mod that had the blessing of Matt Stone & Trey Parker but the parent company still sent a C&D to the team. Since a Dungeon Keeper MMO is in development it almost doubles your chance of getting a take down notice.
We have little worries in the way of a C&D from EA as they aren't really renowned for slamming down on Fan projects, they even support some fan projects for one of their most used IP's Command and conquer.
After being told numerous times from several employees that what we are doing should be ok, we think we got a chance, and while these words mean we don't completley have definite permission it is still something.
On another note we have another two programmers on the team, Spliter and ballwinkle, hopefully artists will be enticed to help out with our project.
In other words, no. It wont. And the shear fact you are showing such little disregard for other peoples work is showing people not to help you.
Anyhow, We did decide to change the look of the creatures in a new way, while we will still be using the same names for the creatures, it should make it a little less "copyright infringing".
Just change the names, change the designs slightly, and stop being lazy. Its much better than doing a lot of work and getting it totally destroyed with no chance of change later on...
It's obvious it isint going to be rebooted, the series has been long dead, the company that made it is dead, and the company that owns the rights to it clearly doesn't give a crap. WE have tried contacting them, with several different approaches, they just don't seem to care.
I know what its like to have somebody tell you to stop what you are doing, and nobody is suggesting you stop anything... Simply stop referencing Dungeon Keeper at all, but make it perfectly clear your game is being made in the spirit and style of the series. Simple as that. A few names here are there and maybe a design or two are all that needs changing to secure your RIGHT to release this. If you release this without first getting 100% confirmed proof that what you are doing will not be touched in any way shape or form, then you risk having a lot of wasted work just thrown away with a single email...
Whatever you choose, good luck to you and I hope it goes well... But just think a bit about what you really want more.
