I think it's clear he didn't intend it as fanart, since people who work on fanart usually are quite eager to promote the thing they are making fanart of. In the end it comes across a bit suspect but it's morally ambiguous territory.
Makes you wonder, if he was going to put so much effort into redesigning all the particular details of it and lighting it differently, why steal someone else's silhouette and pose directly? Very strange.
