I come to you with a pretty retarded question that I just haven't bothered until now.
Okay, so here is the deal, I have Max 8 -.- Had it for 3 years or so.
Now there is obviously max 2010. Do you guys actually have to pay all that money for each version?

as far as I know (or what I heard) autodesk even offers a PDF where you can transfer licenses from person to person so that you can use the patches and service packs and support for your version. So if you'd happen to buy a used license from lets say max2009 it should be possible to transfer that license to you and with that it should be as good as if you bought it a year ago instead of now just the newest with the higher price tag.
I cant fully guarantee this but a close friend told me this as he had a long experience with max licenses.
I have to work next week with a company that only has max 8 as well and it sucks because many of the scripts I write for the project do not work in that release and I also can use less free scripts / plugins for it.
The legal owner does not change, only the machine it works on changes.
- To transfer you first have to install 3dsmax on the other machine, they assume you will use the DVD they sent you (instructions actually say that) the 30 day trial works too.
- Then you export a list/code for that newer computer.
- Then on the old you import that list/code and then you're clear to export the license specifically to that new computer.
- The old system stays locked until you port the license back. It goes give you a 1 day grace period in case you forget.
I would be weary of anyone saying they would transfer a license legally to you using that method. You won't be the legal owner, just using a license someone else owns. Legally they are entitled to upgrades and support not you. More then likely they are unlocking their version, and reselling the lic transfer to someone else...

Where I was wrong is that you are NOT allowed to sell (and therefore be able to buy legal) the software. But license transfer is possible.
And yes being able to buy legal older releases (like a less bloated Photoshop version) would be nice in the industry.
There are however also some variations in each country like how License Agreements are valid (like in Germany they are not valid if they are not on the package itself but only appear after you already installed or are about to install the software - its not legal here then because you didn't knew it before you were buying the product). And also 2nd hand software dealing varies from country to country - I remember some Oracle or similar stories that went to court in Europe because of that.
the license transfer option (PDF stuff) is very useful for companies that switch their names, or lets say artists that leave a company and receive software that they may keep (the company itself then cant use the license and software anymore). As long as no money is being transferred its legal.
The other thing that I heard now is that in Europe autodesk has to offer the option to install max on max. 3 computers with 1 license. So if you live in the EU have a workstation and notebook and netbook you should be able to install in on all 3 and probably use them all at the same time.
