wow ,looks as though I am starting a game dev company. Can't give too many details right now but yeah I had always planned to go down this route and finding a good partner was always the problem.
Cool! What direction are you taking it(console, handheld, mobile, casual, hardcore)? Im kind of wondering because you hardly hear about new companies that succesfully start of without making casual/mobile games.
It's important to know you have to want to run a business, not do what it is that the business does. The plan will help you take a good look at what it takes financially, legally, and personally to make it work.
Having gone down the same path these last 3 years, I truly hope you meet with success. When I started out, I wish I had someone I could turn to for advise or help. Not that I am any authority, but please let me know if I can help in the coming days.

As a business owner, let me offer you some advice. Whatever amount you choose as your startup cost, add at least 10% more. Shit comes out of nowhere all the time. For example, our credit card processing company threw down a $12,000 deposit requirement when we opened out of nowhere, and we had to buy some crap from another place without hesitation in order to take CCs.

Make sure to write a business plan. It is a necessary evil. You need to do some research and plan how it will all pay for itself, your employees, and you.

we are not making mobile phone games, but the project seems quite exciting really.
my partner is an experienced game developer and has had a fair bit of success in the indie scene but we are just moving it up a notch
As I say it early days and a lot could happen in the meantime.
We have to start off small though and see how that develops. I am actually very optimistic about it
