Technically your country of origin and whether they're a signatory of the Berne Convention (iirc). Enforcing that is another matter though.
If you're in the EU, member states are putting together legislation to cover Orphan Works based on common ground between them; the UK white papers have more 'pragmatic' solutions for instance. But, EU mandates would in theory override local laws (which is why citizens of member states aren't being allowed 'referendums' with regards to other political issues).
So does that mean every time something "we the people" don't like is passed through we should engineer a catastrophic financial meltdown as a distraction?
