So here is finaly a character i hope to finish this time...
He is a pretty simple normal dude.

The smoothing is still a mess :> and the area betwean the legs is pretty hard..

I am trying to use spheres for the eyes, but I cant figure out how this technique should work like its sticking out everywhere o.O and how its now then i should texture the inside of the eye hole :O

I would normally have an 'eye hole' though, then just move the verts around to match the sphere
Re the proportion, is the upper torso just a bit long?
Back of the head from the side view looks a bit bashed in too. I would really find some good ref to get your proportions spot on.
I am using a picture ref, the guy just got a baggy shirt, i will tweak it a bit more tough
And it looks bashes because the that part isnt finsihed yet,
Here is an update. I looked at the fatguy sdk and the biker to see how they did the eyes. Is there any website with more details about these movable eyes and mouths techiques?
I still have to add more polys to the shirt and make some wrinkels in the pants...
