Hi is there a way to build directly over another polygonal surface in max? and I can use a spline with that technique?

you can't use a spline with this, but you can build over a 3d surface.

if you want to draw splines on top of a mesh, there are scripts to facilitate this, e.g. splinepainter.

Thankyou , I meant more like creating a cube on an inclined surface or model splines on it?

You can use [x] Autogrid when creating primitives..
