Proper protocol on using concept art

I can't seem to find a thread about this, though I'm sure the topic must exist. (Side-note - isn't there an advanced search function for this site?)

But I'm wondering what appropriate steps should be taken in order to use someone's concept art. For example, if I find a piece by an artist on Conceptroot, should I just send them an email and ask if it's ok to reference their art? Or can I simply put their name and info on the final piece if I use it in my portfolio?

I've tried contacting a few, but haven't heard back. Any advice is appreciated.

    I'm not sure what to do about non-replies.
    But, it's always good to ask, if they say no, then obviously don't use it. But, always be sure to credit them, even if they say it's ok, or you hear nothing. It's unlikely, but they might ask you to take the piece down later.

    Funny coincidence, one of the artists replied right after I posted this.

    Anyway, the concept was actually used in a AAA title. But he's fine with me recreating it. Are there rules against that? Basically redoing what a hired professional did.

    There are no definitive rules, copyright is a labyrinth of ambiguity and subjectivity, especially when creating new work based off an existing design. If you are just wanting to create 3D art for your portfolio based on their designs I would just be sure to credit the artist out of respect.

    If you are going to make money out of this though (turbosquid, unity asset store, freelance assets) then that is different. I would definitely contact the artist requesting permission first.

    Yeah I should've mentioned this is strictly for portfolio work.
