Unless you make a 1-1 copy, no. Photo reference is acceptable and necessary, and never really credited, so using another model instead of a photo is perfectly fine as long as you don't blatantly recreate it and claim it as your own.

This will sound really obvious but what's wrong with google images? Just search for hi res pictures of human anatomy ( I don't see why you need to copy that gladiator exactly, google some gladiator armour)

If you copy a copy there is a high chance you'll copy their flaws and never see the things they missed.
Yeah, an imitation of an imitation will lack details, considering that the references he's using is an approximation of who knows what reference, you are not even sure of some shapes with multiple photos of the same object, I can't really imagine why someone would do that.
