I'm using it to make a generic human male in underwear.

Unless you make a 1-1 copy, no. Photo reference is acceptable and necessary, and never really credited, so using another model instead of a photo is perfectly fine as long as you don't blatantly recreate it and claim it as your own.

why use a model when you have tons of photographic reference out there?

This will sound really obvious but what's wrong with google images? Just search for hi res pictures of human anatomy ( I don't see why you need to copy that gladiator exactly, google some gladiator armour)

Oh, like I said I'm modeling a human male in underwear, not a gladiator. I just like the pose that guy is in.

Yeah, an imitation of an imitation will lack details, considering that the references he's using is an approximation of who knows what reference, you are not even sure of some shapes with multiple photos of the same object, I can't really imagine why someone would do that.

The real problem of referencing from someone's art is you pick up all their errors as well. So if you can use real reference, by all means do.
