3ds max directx shader crashes

i have been having trouble with 3ds max viewport directx shaders for some time now, basically when i us a directx material within max, as soon as i load/refresh a .fx file i get the usual 'error has occured. program will now close. want to save backup file?' thing.
when i start up shaderfx, i get to apply a directx shader and have it show up correctly, but crashes pretty fast after playing around with a few settings.
i have already updated graphic drivers, uninstalled and reinstalled shader fx. also tried on an older version of max that i had still installed, didn't work with that one as well, so i didn't bother reinstalling max yet. I am pretty sure that directx shaders have worked for me before, but i don't really know what has changed to cause this problem now :(
oh, and i'm running max 2009, on vista 64, gforce 8800 gt. if that helps.
