So by the looks I want a CopyTransform constraint with 0 influence, when needed I set the constraint to copy (Armature > Hand) transforms then for the sake of exporting the animation I set Visual keyframes (visual applies constraints before setting the keyframe) its a bit finicky but I guess its easier than manually… -

Nevermind, I got it haha! Those darn orient constraints! They are certainly a plague in Maya. Remember everyone, if you don't freeze your transformations on your controllers before you orient constraint to a joint with them, your orient constraint gets a negative 300 x rotation on them, probably. yes, to prevent the the pole vector constraint to create a pop in the joints orientation, you need to create it on the virtual plane, that is defined by the joint chain. If you dont want the constraint directly on the joint chain, you can model a poly triangle around your joints, offset its size, and place it on this plane…
