I sometimes have that with Max when using very big PSD files, I assume it is because max already detects that the file is being altered or is changed even though PS is not yet done saving it tries to load the files already- as soon as PS done max is still accessing the file resulting into a failure on PS side for the whole… -

It's probably a graphics driver issue. Depending on what video card you have you might want to update it's drivers, or switch max to another display mode. Newer max versions default to the Nitrous display driver which doesn't run so well on older cards. Switching back to Direct3D works best on the older hardware, you do… -
