Its possible that pixologic didn't tested this enough and this is overall data handling bug. This need to be reported even if test case is ridiculous. However, layer system in zbrush is very buggy and error-prone. I use it all the time and have learned lots of strange rituals to avoid fucking up my sculpts.
AFAIK, there's no concept of "second hand" software. You either have a license or you don't. It doesn't get cheaper just because someone else already registered it. Yeah this is a long standing Zbrush bug. One I reported years ago, and no fucks were given by Pixologic. I had the issue with a model from Maya though, not Max. Really sucks to see that this is still an issue. Probably means all the other UV issues such as unwelding them at the vertex level are still there.

It might be worth looking into the new Qremesher that Pixologic put into the latest R4 update. If I am not mistaken it can optimize a mesh in quads. It might be wrong though, havent had time to look into the new features yet. Also I have heard Meshlab might be capable of quad based optimization as well.
The question is why should one replace his modeling software with Zbrush? Sure, the videos made by Pixologic look fun, but actual models shown are rather sloppy. And it would take much more time to make accurate shapes in Zbrush than in conventional software. For now sculpting is only good for organics and shape study.
