My max is setup as follows: Generic Units 1 unit = 1 centimeter If I keep Generic Units and do 1 unit = 1 Inch I get the same size block in UDK and the same height issue.

Humm not sure about Unity but 1 max unit is 1 unit in Unreal or Source. Maybe doing a test, export something that's 1x1x1 in max and see what it measures to in Unity? I would not be surprised if its 1:1 also.
