I'm thinking It's strange to think of anything digital as used. There's no wear and tear like what you would get with physical copies. What difference would there be in the eyes of the person owning the used digital game over a "new" copy other than it being cheaper? I think Steam already does and alright job discounting… -

It's not an issue with the TV! A lot of newer sets do not support the sync on green, as a form of copyright protection. MS dropped the ball.
