In edit poly I can't do a weld similar to above in max. Is it because it does not like the topology created? I am trying to weld hair planes to a low poly character and can only do it in stinky edit mesh. If I do the weld in edit mesh and convert to edit poly then the offending tris are separated! Any ideas?

There's no reason to bother welding it. When you skin it the envelope will catch all the vertices if you've snapped them together.
You could model it in mesh, though you should check how your exporter treat it.
Or in poly and use the edit normals modfier to unify the smoothing.
