weird performance issues

to start off, yes, i have the latest nvidia drivers.
i have a nvidia geforce 9800 GT card, but with some odd issues.
it runs crysis on high and stuff, and can show millions of textured polygons (clocked about 10 million in mudbox with barely any slowdown)
but in max, i've created some spline objects, or more correctly, 56 spline objects. each with about 64 spline vertices, and 48 spline edges, so thats about 3456 vertices total, and 2592 edges.
it should be a piece of cake for my card to render. instead it stutters like an old lady taking a big crap.
i'm using 64 bit vista, my old 7900 had some issues in 32 bit vista, but it was uniformly slow, and started stuttering at around 100 000 polygons in edge mode.
this one however, stutters inconsistently, in intervals even with just 1 object with 64 vertices and 48 edges, and has a really bad framerate with all 56 objects active.
so what could be the problem here?
oh, and its not overheating either, GPU stays at around 50-52, and increases to 56 degrees.
